At SportsBoss, LLC, one of our main priorities is transparency relating to the privacy of our visitors and customers. This Privacy Policy describes the personal information that is collected and received by SportsBoss, LLC and its subsidiaries and affiliates (collectively, "SportsBoss," "we," "us," or "our"), including via our website at https://www.matboss.com (the "Site"), our mobile application (the "App"), and all related services, software, and documentation made available by SportsBoss (together with the Site and App, the "Services"), and how that information is used. This Privacy Policy is incorporated into and made a part of the SportsBoss Software as a Service Agreement and Terms and Conditions of Use (the “Agreement” or "Terms of Use"), available at https://www.matboss.com/terms As used in this Privacy Policy, "Services" has the same meaning given to that term in the Agreement. Capitalized terms not defined herein shall have the meanings ascribed to them in the Agreement.

By using the Site or App or otherwise disclosing your personal information to us, you acknowledge that you have read and understand this Privacy Policy and agree to its terms. You are encouraged to review our Privacy Policy whenever you visit the Site or App to make sure that you understand how your personal information will be collected, used, and disclosed. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, DO NOT ACCESS OR USE THE SITE OR THE APP.

This Privacy Policy does not extend to anyone whose personal information is not under our control or management, including data that is collected by other websites that you may visit before or after the Site, and that are not governed by this Privacy Policy. We are not responsible for the data protection or privacy policies of any other websites or apps, and accept no responsibility or liability for their practices or policies. Please carefully check the policies of other websites and services you use before you submit personal information.

The Types of Personal Information Collected and Received.

We collect and process certain types of personal information. Depending on your use of our Site or App, this may include:

  • Personal identifiers, such as your name, address, email address, phone number, IP address, username, password, and date of birth;
  • Financial information you provide to us, such as your bank account number, credit card number, debit card number, or other financial information;
  • Commercial information, such as information about the products you purchased, obtained, used, or considered or other purchasing or consuming histories or tendencies;
  • Information about your internet or similar network activity, such as browsing history, search history, device information, browser information, and information about your interaction with the Site, App, or advertisements;
  • Information about your athletic activities, events, teams, positions, participation, performance, capabilities, and achievements;
  • User content, including comments, photos, audio, and video that you create, import, upload, or publish through our Site or App. Even if you are not a user, information about you may appear in user content on our Site or App;
  • Communications, such as via email, in-App messaging, phone, and other channels;
  • Professional or employment information;
  • Information about your geolocation, such as your physical location based on IP address, device data, or region;
  • Your physical or audio characteristics or descriptions, such as when a video or photograph of you is uploaded; and
  • Inferences we draw from your personal information, such as a profile reflecting a person’s preferences, characteristics, and behavior.

Please note that personal information for the purposes of this Privacy Policy does not include aggregate or de-identified information from which individual identities have been removed.

We also encourage parents and guardians to observe, participate in, and/or monitor and guide their children’s online activity. We do not knowingly solicit or collect any personal information from children under 13 years of age, and children under 13 are not permitted to use our Site or App. If we become aware that a child under the age of 13 has provided us with their personal information, we will delete it.

How We Collect and Receive Personal Information.

Personal Information You Provide Directly. We collect the personal information you provide to us directly when you fill out a form on our Site or App; register for an account with us; contact us by email, letter, or phone; interact with us on social media; use or interact with our Site or App; or engage in a transaction with us.

Personal Information Provided About You.

We also collect personal information about you provided to us by others in order to enable you or them to use or benefit from our Site or App. For example, coaches, leagues, clubs, teams, schools, colleges, and universities may use our App or Site as part of their athletics programs. Your coach, league, club, team, school, college, or university may provide us with your personal information or allow us to collect your personal information so that the App can assist in scoring sporting events that you attend or are involved in.

Please note that if you are sharing or allowing us to collect someone else’s personal information, you must be legally authorized to share such information on their behalf.

Automatically Collected Personal Information - Cookies and Tracers. We and our third-party partners may use cookies and similar technologies (e.g., web beacons, pixels, ad tags, and device identifiers) to recognize you and/or your device(s) on, off, and across the Site, App, and different devices. A cookie is a small file that is placed onto your device (e.g., computer, smartphone, or other electronic device) that stores information when you visit a website. You can control certain cookies through your browser settings and other tools. Please note that if you disable cookies, some features of the Site or App may not function properly. SportsBoss does not control cookies placed by third-party advertisers and is not responsible for any information collected through such cookies.

The cookies used fall into one of the following two categories:

  • Session cookies: these allow our Site to link your actions during a particular browser session. These expire each time you close your browser and do not remain on your device afterwards.
  • Persistent cookies: these are stored on your device in between browser sessions. These allow your preferences or actions across our Site to be remembered. These will remain on your device until they expire, or you delete them from your cache.

How We Use Personal Information.

  • To provide and deliver our products and our Site and App. Some features in our App and Site use artificial intelligence and machine learning (“AI”), such as our Digital Insights feature;
  • To allow you to create, log into, and access your account (if any);
  • To provide customer service;
  • To process any purchases, transactions, or payments made on our Site or App;
  • To keep your information and our systems secure such as by detecting security incidents, and to be able to verify your identity and contact information;
  • To provide advertising and to alert you about updates, special offers, and other news, services, and information from SportsBoss, our partners, or others;
  • For testing, research, analysis, and product development, including to develop and improve our content, Site, App, and products, including SportsBoss’s own AI-powered features. SportsBoss does not sell personal data for the purpose of training third-party artificial intelligence or machine learning models;
  • To ensure our content, Site, App, and products are functional, efficient, and relevant to you and your interests;
  • To respond to your inquiries and requests;
  • Enable coaches, leagues, clubs, teams, schools, colleges, and universities to use the Site and App;
  • To protect against, detect, and investigate fraud;
  • To enforce our Terms of Use, agreements, or policies;
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; and
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets.
  • We may also use personal information for other purposes described to you at the time of collection or with your consent.

How Personal Information May Be Disclosed.

We do not sell or rent any of your personal information, and we do not share your personal information publicly without your consent. We disclose your personal information to the following categories of recipients:

  • To our service providers: We rely on certain trusted third-party service providers to provide, improve, promote, or protect our Site and App. These service providers perform services on our behalf, such as data storage, payment processing, customer service, analytics, security, and advertising services. Our service providers are contractually obligated to protect personal information and may only use it for the purposes for which it was disclosed.
  • To our affiliates and subsidiaries: We may disclose your personal information with our affiliates and subsidiaries.
  • To our business partners: We may disclose your personal information to our business partners, or allow them to collect your personal information, to offer you certain products, services, or promotions, or to evaluate or improve our or their products, services, or marketing.   • For a change in control: In connection with any merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets (whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding), we may disclose or transfer personal information to the acquiring entity or other relevant parties as part of such transaction. In such event, we will use reasonable efforts to direct the transferee to use personal information in a manner consistent with this Privacy Policy.
  • As necessary or otherwise required by law: We also reserve the right to disclose personal information when we believe in good faith that such disclosure is reasonably necessary to (a) comply with applicable law, regulation, legal process, or governmental request; (b) protect the rights, property, or safety of SportsBoss, our users, or the public; (c) enforce our Terms of Use or other agreements; (d) investigate or prevent fraud or other illegal activities; or (e) protect against legal liability.
  • At your direction, request or consent: We may disclose or allow access to your personal information if you otherwise consent, request, or direct us to do so.
  • To other users and the public: Certain features of the Site and App may allow you or others to share personal information with other users or make it publicly available. For example, athletic statistics, scores, videos, and other user content may be viewable by other users of the Site and App, and in some cases, may be accessible to the general public. The App also includes sharing features that enable users to generate and distribute links to selected content with third parties, including individuals who do not have an account. Any personal information included in content shared through such features may be accessible to recipients and others who obtain access to the shared link. You acknowledge that any information shared through such features may be viewed, collected, or used by others. SportsBoss is not responsible for personal information that you or others choose to share or make public through the Site or App.

Protection of Your Personal Information.

We take the security of your personal information seriously. We have therefore implemented commercially reasonable administrative, technical, and physical safeguards designed to protect the personal information that we receive against unauthorized access, destruction, or alteration.

Please remember, however, that the safety and security of your personal information also depends on you. Where you have chosen, or where we have given you, a user name and password for access to certain parts of the Site or App, you are responsible for keeping the user name and password confidential and for any activity that occurs under your account. We ask you not to share your password with anyone. No method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security. We are not responsible for circumvention of any privacy settings or security measures contained on the Site or App.

Data Transfers.

Because SportsBoss, LLC is a US-based company, your personal information may be collected and processed in the United States. Additionally, as part of the Site and App offered to you, information that we receive about you may be transferred to and stored in one or more countries other than where you currently reside. For example, this may occur if any of our servers or third-party service providers are located in a country other than yours. These countries may have different data protection laws than your current residence. However, if we transfer your personal information in this way, we will put in place appropriate protection to make sure it is treated in line with this Privacy Policy.

Marketing Messages.

We give you the ability to opt-out of the marketing communications we may send. You can opt-out of receiving marketing emails or mobile device notifications from SportsBoss by selecting the “unsubscribe” link at the end of email communications to you. Please note that even if you unsubscribe from marketing communications, you will still receive certain required communications from us, such as messages confirming orders, etc.

Retention.

We will keep your personal information for as long as is reasonably necessary to fulfill the purposes for which it was collected, to perform any applicable contractual obligations, or as required or permitted by applicable law. The relevant retention period is determined on a case-by-case basis because it depends on things like the nature of the data, why it is collected, why it is processed, and any relevant legal or operational retention needs. For example, we may retain your data for as long as you maintain an account with us or as needed to provide you with our products and services. Following termination of your account or when the relevant processing activity has been completed, we may retain, delete, or anonymize your data in accordance with our data retention policies and applicable law. We have no obligation or liability to you or any other party with respect to personal information that is deleted, destroyed, or anonymized in accordance with this Privacy Policy.

Governing Law.

This Privacy Policy and any disputes arising out of or relating to it shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict-of-laws principles. To the extent you have accepted the Agreement, the dispute resolution and jurisdiction provisions of the Agreement shall apply to any disputes arising under this Privacy Policy. To the fullest extent permitted by applicable law, you agree that any dispute arising out of or relating to this Privacy Policy shall be resolved on an individual basis, and you waive any right to bring or participate in any class, consolidated, or representative action, consistent with the terms of the Agreement.

Updates and Changes to this Privacy Policy.

We may update this Privacy Policy from time to time in our sole discretion. When we make material changes to this Privacy Policy, we will notify you by posting the updated policy on the Site and App and updating the “Last updated” date above. Any updates to this Privacy Policy will not apply retroactively and will become effective upon posting unless otherwise stated. Your continued use of the Site or App after any such changes constitutes your acceptance of the updated Privacy Policy. We encourage you to review this Privacy Policy periodically for any changes.
